Detention Review Hearings

Protecting Your Rights When Immigration Detention Is at Stake

If you have been detained by the Canada Border Services Agency (CBSA) for immigration reasons, you may have a detention review hearing before the Immigration Division of the Immigration and Refugee Board of Canada (IRB). The first review generally takes place within 48 hours of detention or as soon as possible afterward, where an IRB member decides whether you should remain detained or be released.

Our immigration lawyers provide professional representation and legal guidance for detention review hearings, helping you understand the reasons for detention, prepare evidence, respond to CBSA’s position, and present an appropriate release plan. Depending on the circumstances, alternatives to detention may involve conditions such as reporting requirements, a residential address, or a bondsperson

How We Can Help

01

Detention Review Representation

We prepare and present your case before the Immigration Division, responding to the reasons for detention and presenting relevant evidence and arguments on your behalf.

02

Release & Alternatives to Detention

We help develop a practical release plan and prepare supporting evidence concerning potential alternatives to detention, including suitable bondsperson arrangements where applicable.

03

Continued Detention Reviews

If release is not granted at the initial hearing, further reviews generally take place within 7 days and then every 30 days. We can continue to assess your circumstances and present new evidence or changed circumstances that may support release.
